6. SPECIAL PERMITS

d. Payment receipt of established fee (currently not being requested as a consequence of the judgement of the Constitutional Court of June 23, 2017) e. Program of activities with the corresponding description f. Minimum investment plan committed. g. Financial statements. h. A copy of the notification submitted to the relevant municipality, indicating the intention to submit the application for a mining exploration concession. i. Affidavit j. Power of attorney, duly authenticated The time in which the procedure is carried out: If within fifteen (15) days following the publication, an opposition is filed and being of an incidental nature, it will be processed separately, according to the corresponding administrative procedure. If no opposition is filed, or the one filed has been resolved, the Mining Authority shall decide on the application and mining concession, within a period no greater than forty-five (45) days. The Mining Authority will issue the corresponding resolution. If favorable, it will order its registration in the Mining and Cadastral Registry Unit. The exploration concession for non-metallic minerals and gems or gemstones has a maximum duration of two (2) years from the date of its award.The exploration concession for metallic minerals shall have a maximum duration of five (5) years, counted from the date of its granting. In both cases it may be extended for the same period, only once. 6.12.2 EXPLOITATION CONCESSION PERMITS The Exploitation includes the operations, works and mining works for the preparation and development of mines, for the technical and rational extraction of minerals, their commercialization and processing. REQUIREMENTS: a. Inspection fee for the exploitation stage. b. Public Deed or document that accredit in legal and due form the ownership of the surface land where the mining activity will take place. In case of not being the owner, the respective authorization or contracting of the owner of the property granted in accordance with law and, which must be duly registered with the mining authority and, if the exploitation is alluvial (river), accredit respective easement where appropriate. c. Technical report of the exploration results containing: •Method of extraction and description of the operating plan and/or

benefits (Process flow plan, mined plan) • Description of the design of the site or sites to be exploited, sterile deposit and organic matter • Projected volumes of production • Volumes of sterile matter and organic matter to be removed • Equipment to be used (technical description) • Human Resources (Organizational structure of the project, positions, and managers) d. Schedule of activities detailing the monthly implementation times (Adequacy, estimated dates of exploitation, operation, and closure). e. Minimum investment project containing the construction budget (adequacy and installation) and the industrial execution budget (operation). f. General plans: project design (all plans must be Geo-referenced in the Mercator Transversal Projection (UTM): NAD27 system: with its respective coordinates table). g. General plans of the project: Location of all the elements of the mining process (mining area perimeters, carriage routes, administrative offices, warehouses, necessary parking areas, mineral storage areas, mining effluents, shredders, sieves, conveyor belts, water pipe, septic tank, latrines, location area of explosives if applicable). The location of all the elements described above will depend on the substance of interest to be exploited and the process to be carried out. h. Process plant design if available. i. Design drawing of the mine with its transverse and vertical sections delimiting the body or bodies to be mined.
